A police source says team owner Ralph Wilson, and General Manager Russ
Brandon will be subpoenaed to testify in front of a Grand Jury in the
Marshawn Lynch case later this month.

Three of Lynch's teammates and the team Chief of Security, Chris Clark,
were subpoenaed today. No names mentioned

A police source reports that Bills' personnel refused to answer
questions about the incident and referred police to their attorneys.

What incident was Hardy involved in here? Being in a car involved in a
hit and run? It's not like he was driving.

Problems with police

Police told The Buffalo News that Lynch has no arrest record in New York
State and has a clean driving record in the state.

But some police officers in Buffalo and Hamburg are not surprised to hear
that Lynch is having legal difficulties.

Lynch was tossed out of two Chippewa Street bars in recent months because he
brought in his own bottle of liquor, which is illegal under state alcohol
laws, according to three law enforcement officials.

"[Buffalo police] have been told by bar owners that he'll walk in, order a
glass of pop and pour his own liquor into it," one officer said. "He was
told that you can't do that, and it doesn't matter if you're Marshawn
Lynch."

Law enforcement officials in the Southtowns said Lynch attended a meeting
several months ago with three high-ranking members of the Town of Hamburg
police. At least one member of Lynch's family and a Bills security official
also attended.

The meeting was arranged after Lynch complained that police were being tough
on him and his family, said a police official who works closely with that
department.

"From what I understand, it was a case of 'Let's clear the air here,' " the
source said. "They thought the police were picking on them."

Town police impounded a vehicle that Lynch had been using and lent to a
relative. Authorities said the vehicle was impounded after that relative was
arrested for violating a vehicle and traffic law.

After the impoundment, Lynch went to Police Headquarters to reclaim the
vehicle, but police wouldn't give it to him, because it actually belonged to
a local car dealer.

Lynch had a disagreement with some police personnel over the release of the
vehicle, apparently prompting the clear-the-air meeting, sources said.

In addition, Orchard Park police investigated one minor incident, last Dec.
13, near the end of the Bills' season. A vehicle apparently driven by Lynch
struck a pole outside Ralph Wilson Stadium. Police responded, but no charges
were filed, according to Orchard Park police records.

Town of Hamburg police have dealt with Lynch and his family on mostly minor
matters, usually involving vehicle and traffic laws.

That is why one law enforcement official was not surprised to hear about the
latest incident involving Lynch's vehicle.

"God, no, I wasn't surprised at all," the source said. "It follows a
pattern. It's the kind of stuff he's been doing. He's just so cavalier about
everything. That was always my impression."

I think this is a pretty good article on seeing things from the lawyer's
point of view. I'm not sure I agree with it, but it gives another
perspective to this whole problem.

Lynch: Mike, got a question for you. Hypothetically speaking, what if
a driver is out at a bar….hypothetically, of course, and on the way
home he hypothetically hits someone with a car and hypothetically left
the scene without hypothetically stopping?
Caffery: Any witnesses?
Lynch: Uh, hypothetically speaking, there were a couple of people in
my…uh I mean…the hypothetical car.
Caffery: First of all, did the police call you? Don’t say a word.
The prosecutor can’t force you to talk and….
Lynch: Who said it was me?!?!?
Caffery: Fine, they can’t force this person to talk. Not one word.
Lynch: Can this person end up in jail and lose their spot on a
hypothetical NFL football team? Hypothetically speaking that is.
Caffery: Well sure. It’s a serious matter to hit someone,
particularly when they are under the influence….
Lynch: Who said I was…..uh….that the driver was under the influence?
Caffery: Look Marshawn, let’s cut the crap. We'll get you out of
this. It's the NFL after all. A few things here to consider. First,
it’s a dark night and this was an accident. This kind of thing
happens all the time. People panic and flee accidents like this all
the time. Second, the victim was not seriously injured. Third, there
are no witnesses. And fourth, and most importantly, the constitution
says that you are not required to be a witness against yourself. You
don’t have to say a word. The state has to prove you are guilty.
With no witnesses it’s their word against yours. And if OJ can walk,
there is no chance in * that you are doing any time.
Lynch: What about the other people in the car?
Caffery: Be nice to them. Very nice. They have your nads in a
vice. They could suddenly disappear...(rubbing chin with evil glare
and sly smile)....uh...oh...uh....just kidding.
Lynch: *, that Gaddis guy is a cheeseball, but….gotta do what I
gotta do.
Caffery: Marsh….can I call you that?
Lynch: yeah, whatever…
Caffery: The longer this drags on the better it is for you. That
means no one can place you behind the wheel of that car. Once we get
past the subpoenas on the other fellas and we can keep their flaps
shut I’ll start the PR campaign with the usual ‘prosecution has no
case…let this go…Marshawn has suffered bla bla bla’ routine.
Lynch: Man, can I hit Chippewa Street again?
Caffery: I’d advise against it. And stop sneaking booze in to a bar.
That's just crass, man.

The key point from that article:

"The 'Just Shut Up' rule applies, said Connors, whether you are innocent or
guilty. The classic example is the innocent man accused of murder who tells
the cops he never liked the guy, but he did not kill him. Comes the trial,
and the cop testifies that the accused admitted that he did not like the
victim.

'Right there,' said Connors, 'you’ve got your motive.'"

His involvement was just being in the car. I highly doubt he was driving
Lynch's $100K car. And he's clamming up because that's what his legal
counsel is telling him to do. Not to mention he doesn't want to squeal on
a brother and teammate.

He's clamming up because to do so puts in doubt who was driving.
Without a clear picture of who was driving the prosecution can't go
forward. From a defense standpoint that's why it's imperative that
all occupants of that vehicle keep quiet.
